2. In this case, the petitioner is seeking regular bail in connection with Ariyari P.S. Case No. 65 of 2025, registered for the offences punishable under Section 309 of the BNS.
3. As per allegation, on 19.05.2025, the informant was intercepted near Ariyari petrol pump by four unidentified men on motorcycles who assaulted him with sticks, causing severe head injuries. The assailants looted Rs. 2,000/-, his mobile and motorcycle and fled away.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It has further been submitted that the FIR has been lodged against unknown persons and the petitioner is not named in the FIR. Name of the petitioner has been transpired on the basis of
Patna High Court CR. MISC. No.70112 of 2025(2) dt.13-01-2026 2/2 confessional statement of co-accused Shambhu Kumar, who has been granted bail by a co-ordinate Bench of this Court. No incriminating article has been recovered from the possession of the petitioner and except confessional statement of co-accused, there is nothing in against him in the entire investigation, to show his involvement in the present case. The petitioner is in custody since 11.07.2025.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Sheikhpura in connection with Ariyari P.S. Case No. 65 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. The petitioner shall physically appear before the learned court below on each and every date. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
