Petitioner apprehends his arrest in connection with Sitamarhi (Mehsaul O.P.) P.S. Case No. 582 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 186, 189, 353 and 283 of the Indian Penal Code and Sections 3⁄4 of Bihar E.S.M. Act.
Allegation as per FIR is that one murder took place and thereafter the petitioner and others assembled there and created road blocked and also assaulted police personnel by fists and slaps.
Submission of learned counsel for the petitioner is that large number of person have been made accused including the petitioner and no specific allegation has been attributed against
Patna High Court Cr.Misc. No.24343 of 2018 (2) dt.03-05-2018 2/2 him.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi (Mehsaul O.P.) P.S. Case No. 582 of 2017, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
