2. The petitioner has preferred this application for grant of regular bail in connection with Pipariya P.S. Case No. 46 of 2025, dated 17.05.2025 registered for the offences punishable under Sections 137(2) and 87 read with Section 3(5) of the BNS. Later on chargesheet was filed under Sections 137(2), 96 and 64 of the BNS and under Sections 4 and 6 of the POCSO Act.

3. As per the prosecution case, the informant's

No.72142 of 2025(3) dt.11-11-2025 2/3 daughter-in-law (Puja Kumari) is alleged to have administered some drug while cooking dinner and stole 70 grams of gold, rupees 2 lakhs cash and her husband's mobile phone and ran away from her matrimonial home while the family members were asleep due to the effect of drug.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The girl was recovered and in her statement recorded under Section 183 of the BNSS, she has stated that she was tortured by her in-laws for dowry and to save herself from the torture, she left her matrimonial home on her own sweet will as no dowry was provided at the time of her marriage with the informant's son and she came to the house of maternal grandparents of the petitioner without any coercion or force of the petitioner. During the course of investigation it has been found that the date of birth of the girl is 04.02.2009 and on the date of occurrence she is just 16 years of age. There is general and omnibus allegation against the petitioner. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 21.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions JudgeVI-cum-Special Judge POCSO Act, Lakhisarai/Successor Court, in connection with Pipariya P.S. Case No. 46 of 2025.

7. The application stands allowed.
