JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-09-2021 Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Bairagania P.S. Case No. 27 of 2019, registered under Sections 304(B) and 201/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

The accusation is of killing of daughter of the informant, Ram Pratap Sah, by her husband and in-laws due to non-fulfillment of demand of dowry and removing the dead body. Learned counsel for the petitioners submits that

No.67128 of 2019(3) dt.06-09-2021 2/2 petitioner nos. 1 and 2 are brother-in-law and petitioner nos. 3 and 4 are father-in-law and mother-in-law of the deceased, daughter of the informant and they have falsely been implicated in the present case only to give undue pressure. Further submission is that there is general and omnibus allegation against the petitioners having hands in killing of the daughter of the informant. Moreover, Pritam Sah, husband of the deceased, has already been allowed privilege of bail by a coordinate Bench of this Court vide order dated 02.11.2020 passed in Criminal Misc. No. 64917 of 2019.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Bairagania P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
