Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code and u/s 138 of N. I. Act.

It is a case of cheque bounce.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that petitioner issued cheque of Rs. Four lacs which is said to have been bounced but petitioner paid Rs. 2, 75,000/- to the informant through UPI and he is ready to pay the remaining amount of Rs. 1,25,000/- in installments within 8-10 months. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.70659 of 2022(3) dt.12-05-2023 2/2 Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur PS case No.226/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C. with further condition that petitioner shall pay Rs. 50,000/- to the informant at the time of furnishing bail bond and rest of the amount of Rs. 75,000/- shall be paid in two equal installments within six months thereafter failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
