Mr. Pramod Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2025 Heard Mr. Bhagya Narayan Jha, learned counsel for the petitioner and Mr. Pramod Kumar Pandey, learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, all four F.I.R. named accused persons, riding on a motorcycle, came at the place where brother of informant was milking the cow and fired upon him due to which, brother of informant sustained fire arm injuries and died on the spot.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence.

Patna High Court CR. MISC. No.70705 of 2025(5) dt.19-12-2025 2/2 Petitioner is not named in the F.I.R.. Name of petitioner transpired in this case during investigation. As per prosecution case, all four F.I.R. named accused persons have committed murder of brother of informant and he has not whispered or raised any suspicion against this petitioner. Moreover, chargesheet has already been submitted and petitioner is in custody since 02.09.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Danapur in connection with Shahpur P.S. Case No. 197 of 2024.
