This application, for grant of regular bail, arises out of Siwan RPF Police Station Case No. 11 of 2006, disclosing offences under Sections 3 R.P. (U.P) Act.
Learned counsel for the petitioners has submitted the petitioners are innocent and have not committed any offence. In fact, nothing incriminating has been recovered from the possession of the petitioners. The petitioners are rotting in custody for the last four months.
Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioners are the drivers of the tractor on which stolen railway articles amounting to Rs. 1,25,000/- were loaded and sent to the KABAR shop. Moreover,
Patna High Court Cr.Misc. No.37053 of 2017 (3) dt.01-09-2017 the occurrence is of the year 2006 and the petitioners were absconding for about 11 years.
Considering the facts and circumstances of the case, this Court is not inclined to release the petitioners on bail. Accordingly, the prayer for regular bail of these petitioners is rejected.
