The petitioner apprehends his arrest in Gaurichak P.S. Case No.404 of 2018 registered under Sections 363, 366 and 34 of the Indian Penal Code.

The petitioner is alleged to have kidnapped the victim but the victim made her statement under section 164 of the Cr.P.C. and she disclosed her age to be 19 years. The victim disclosed that she voluntarily left her house and went along with the petitioner Rahul Kumar. She also solemnized marriage with him.

Having considered the facts that the victim herself denied the factum of her kidnapping and she disclosed that she voluntarily left her house and married with the petitioner, the above named petitioner, in the event of his arrest or surrender

Patna High Court CR. MISC. No.65777 of 2019(2) dt.18-10-2019 2/2 before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Gaurichak P.S. Case No.404 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
