====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Lalganj P.S. Case No. 31 of 2018 registered under sections 420, 406, 120B/34 of the IPC.

The allegation against the petitioners, is that the petitioners along with other accused persons entered into a negotiation for purchase of 4.50 decimals of land in Plot no. 413, Khata No. 85 at village Matiara but at the time of execution of the sale-deed by interpolation instead of 4.50 decimals the area of the land has been increased to 24.50 decimals by adding on two before 4.50.

No.65229 of 2019(2) dt.04-11-2019 2/3 Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case inasmuch as the sale-deed was duly executed by the informant i.e. vendor and after going through the contents of the sale-deed the informant along with witnesses have put their signatures upon the sale-deed but the informant with oblique motive refused to accept the execution before the Registrar at the time of the registration of the deed and has lodged the present first information report in order to harass the petitioner. Learned counsel further submits that similarly situated accused persons who are also the vendee in the sale deed have been granted bail by this Court in Criminal Miscellaneous No. 59043 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that similarly situated accused persons have been granted bail by this Court, I am inclined to grant anticipatory bail to both the petitioners. Accordingly, the petitioners, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of J.
