The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No.97 of 2022, registered for the offences punishable under Sections 323, 341, 324, 354, 379, 307, 504, 506 and 34 of the Indian Penal Code. The petitioner is said to have assaulted the informant by means of knife.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the allegation against the petitioner is of assaulting the informant by means of knife but no injury was found on the person of the informant.

Patna High Court CR. MISC. No.70731 of 2022(2) dt.02-02-2023 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner by submitting that the petitioner is the main assailant.

Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Hajipur at Vaishali in connection with Bhagwanpur P.S. Case No.97 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
