Petitioner apprehends his arrest in connection with Inarwa P.S. Case No.11 of 2019, for the offence punishable under Sections 363 and 366(A) of the Indian Penal Code. The allegation against the petitioner as per the First Information Report is that the petitioner along with other accused persons abducted the daughter of the informant. Mr. Bimlesh Kumar Pandey, learned counsel for the petitioner submits that petitioner has falsely been implicated in this case under the mistake of fact. Learned counsel further submits that the victim girl was recovered and subsequently her statement under Section 164 Cr.P.C. has been recorded which

Learned counsel further submits that from perusal of the statement of victim girl under Section 164 Cr.P.C., it would be evident that she had gone voluntarily to the house of her maternal uncle. Having regard to the submissions made by the parties and taking into consideration the fact that in the statement made under Section 164 Cr.P.C., the victim girl has not disclosed the name of the petitioner, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bettiah, West Champaran, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
