====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.C-495 of 2016 (Tr. No.1400 of 2018) registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that the complainant Jamadar Manjhi, who was Treasurar of Vikash Swayam Sahayta Samuh, came in the touch of the petitioner Suraj Thakur, in course of visiting at the Gramin Bank. Thereafter, the complainant gave Rs.50,000/- and 30,000/- to the petitioner and the co-accused Santosh Srivastava to supply the clothes but the clothes were not supplied to the complainant and, as such, the petitioner and the

Patna High Court Cr.Misc. No.29072 of 2018(2) dt.10-05-2018 2/2 co-accused Santosh Srivastava misappropriate the aforesaid amount.

Learned counsel for the petitioner submits that while the complainant has made allegation about giving Rs.50,000/- and Rs.30,000/- to the petitioner and the co-accused Santosh Srivastava but no any document has been brought on the record in that regard. In fact, the petitioner has falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Shree Vijay Kumar Mishra, Judicial Magistrate, Siwan, in connection with Complaint Case No.C495 of 2016 (Tr. No.1400 of 2018), subject to the conditions laid down under Section 438(2) Cr.P.C.
