Case No. 44 of 2018, registered for the offences punishable under Sections 363, 366, 341, 323, 504, 506/34 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act. Prosecution case is that petitioner forcibly taken daughter of the informant and kept her in his custody and forcibly married with her and thereafter started demanding dowry.
Submission of learned counsel for the petitioner is that as a matter of fact she married with the petitioner and later on false case has been lodged with respect to demand and there is also delay in lodging the FIR and moreover petitioner is in custody for 10 months and charge sheet has been submitted, as such there is no chance of tempering with the evidence.
Patna High Court CR. MISC. No.65119 of 2019(4) dt.05-02-2020 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Rauta P.S. Case No. 44 of 2018 on the condition that he has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bonds shall be cancelled.
