The petitioner seeks bail in connection with S. Tr. No. 431 of 2025, arising out of Jadopur P.S. Case No. 197 of 2024 instituted for the offence under Sections 109(1), 118(2), 303(2), 126(2), 115, 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. Earlier vide order dated 27.06.2025, passed in Cr. Misc. No. 29839 of 2025, the application was dismissed as withdrawn.

The informant alleged that on 29.11.2024, her husband Harkesh Yadav was assaulted by Naresh Yadav (petitioner) and his son Rajkrit Yadav with lathi and kudal during a dispute over a bullock cart entering their field, causing

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.06.2025. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From perusal of the FIR, it would manifest that petitioner has assaulted the husband of the informant by means of Kudaal. Learned counsel submits that injury report does not corroborate the allegation levelled in the FIR as the injury is opined to be caused by hard and blunt substance. Charge sheet in this case is submitted, thereafter, charge is also framed by the court below, which is evident from perusal of the impugned order. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge being framed, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties
