2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The Petitioner is apprehending his arrest in connection with Maigra P.S. Case No. 14 of 2020 registered for the offences punishable under Sections 387 and 435 of the Indian Penal Code.

4. As per the prosecution case, eight to ten unknown miscreants boarded 3 to 4 motorcycles came on the place of ocurrence and started assaulting the labourer and Munsi due to non fulfillment of demand of Rangadari. They also snatched Rs. 20,000/- from the manager and fled away.

5. Learned cousnel for the petitioner has submitted

Patna High Court CR. MISC. No.73092 of 2023(2) dt.23-11-2023 2/3 that the petitioner is innocent and has falsely been implicated in this case on the confessional statement of co-accused. The petitioner is not named in the FIR and nothing incriminating has been recovered from possession of the petitioner. The petitioner has one criminal antecedent as stated in para-3 of the bail petition, in which he is on bail.

6. Learned A.P.P for the State has opposed the prayer for anticipatory bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, be released on anticipatory bail on furnishing bail bonds of Rs 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate 1st class, Sherghati at Gaya in Maigra P.S. Case No. 14 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C

8. The court below shall verify the criminal antecedent of the petitioner and at any stage, if it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the
