This application is for grant of regular bail in connection with Mahishi P.S.Case No.48 of 2017, registered for the offences under Sections 392 of the Indian Penal Code.
The petitioner is named in the F.I.R. There is allegation that he was member of the gang and put 303 Revolver on the ear of the informant and committed robbery from them. Submission of the learned counsel for the petitioner is that nothing has been recovered and the used motorcycle has been recovered after nine days. The petitioner has no criminal antecedent. It is also submitted that the petitioner is in custody for about three months.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.31468 of 2017 (2) dt.12-07-2017 2/2 Having heard both sides and in view of the fact that he is named in the F.I.R. and the specific allegation has been attributed against him, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial of the petitioner and if possible, the case of the petitioner be separated from the case of other accused persons and try to conclude it within a period of seven months.
With the aforesaid observation, this application is dismissed.
