JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2017 The appellant seeks regular bail in connection with Saran S.C./S.T. P.S.Case No.41 of 2013 registered for offences punishable under Section 341, 323 and 504 of the Indian Penal Code and Section 3(1) of SC/ST (POA) Act.
Allegation against the appellant is that he pushed the informant when she protested about derogatory remarks against her and he also assaulted her.
Submission of the learned counsel for the appellant is that he has been falsely implicated in this case. The appellant is in custody for about 2 1⁄2 months.
Heard learned Special P.P. also.
Having heard both sides and from perusal of the allegation it appears that there is allegation of outraging the
Patna High Court CR. APP (SJ) No.1945 of 2017 (2) dt.11-07-2017 2/2 modesty of the informant and the case is of the year, 2013 and his prayer for anticipatory bail was rejected by this Court in Cr. Misc. No.31089 of 2014 but even then the appellant has not voluntarily surrendered and he was arrested on 30.4.2017. Considering this aspect of the matter, I am not inclined to grant bail to the appellant at this stage, hence, this appeal is dismissed with liberty to the appellant to renew his prayer for bail after framing of the charge in this case.
