JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Islampur P. S. Case No. 288 of 2019, disclosing offences under Sections 366A/34 of IPC.

As per F.I.R. there is allegation of kidnapping of the minor daughter of the informant. Petitioner is not named in the F.I.R.

Submission of the learned counsel for the petitioner is that the girl has been recovered and the statement of the girl has been recorded under Section 164 Cr.P.C., in which, she has not made allegation against the petitioner except that she had gone on her own sweet will along with the petitioner. She has mentioned her age as 18 years before the Sessions Judge. Moreover, the medical report also shows that her age was assessed between 17 to 18 years.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P. S. Case No. 288 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
