2. The petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 210 of 2023 registered for the offence under Sections 302, 120B and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

3. The petitioner has filed this application for bail because of the delay in the trial.

4. Learned counsel for the petitioner submits that out of 12 witnesses, 9 witnesses have been examined and the next private witness who is the informant of the case is going to be examined on 20th of December 2024.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.76139 of 2024(2) dt.17-12-2024 2/2 for bail.

6. In view of the law laid down by the Hon'ble Supreme Court in the case of X vs. State of Rajasthan & Anr, 2024 SCC OnLine SC 3539, I do not find this case to be a fit case for grant of bail.

7. Accordingly, this application for regular bail is hereby rejected.
