The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner set the house of informant on fire.
It is submitted that there is case and counter case. Earlier informant and others assaulted the petitioner for which Baheri PS Case No. 184 of 2022 was lodged under Section 307 and other allied sections of the Indian Penal Code, by coaccused Bhuneshwar Yadav against informant and others and in retaliation the present case has been lodged. Patna High Court CR. MISC. No.1264 of 2023(2) dt.27-03-2023 2/2 sustained injury. Injuries sustained by the petitioners side was found to be grievous in nature. Moreover, some of co-accused have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.01.2023 passed in Cr. Misc. No. 53453 of 2022. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VII, Darbhanga in connection with Baheri P.S. Case No. 182 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
