The petitioners seek bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 110 bottles each containing 375 ml. country made liquor was recovered from the bolero vehicle which the petitioners were boarding. It is claimed that antecedent of petitioner no.1 is clean whereas against petitioner no.2, two criminal cases are pending under Sections 392 and 34 of the Indian Penal Code but not under the Excise Act. Both the petitioners are in custody since 04.05.2017. It is further contended that the driver of the vehicle has already been granted

Patna High Court Cr.Misc. No.31897 of 2017 (2) dt.13-07-2017 2 / 2 bail by a co-ordinate Bench of this Court.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 3rd Khagaria in connection with Khagaria (Muffasil) P.S. Case No.291/2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of case then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
