The petitioner seeks bail in connection with Khagaria Rail P.S. Case No. 40 of 2019, registered for offence punishable under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that nothing incriminating article has been recovered from the possession of the petitioner and he has no concern with the alleged occurrence. The petitioner has no criminal antecedent and he is in custody since 20.07.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
