The petitioner is apprehending his arrest in connection with East Colony (Munger) P.S.Case no.15/18 registered for offences punishable under Sections 120B, 114, 302, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner as per FIR is of murder of two persons by firing by the accused persons and specific allegation against this petitioner is that he has taken money in the election and now he is not returning the money and on demand he threatened to kill the informant and others.
Submission of the learned counsel for the petitioner is that there is nothing against the petitioner except that there is dues of Rs.06 lac against the petitioner and allegation of firing is against
Patna High Court Cr.Misc. No.27432 of 2018 (2) dt.10-05-2018 2/2 the other accused persons.
Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is case of murder and further the petitioner has criminal antecedent..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court. With the aforesaid direction, this application is dismissed. (Vinod Kumar Sinha, J) chn/- U T
