JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in connection with Buxar Nagar P.S.Case no. 190 of 2017 registered under Sections 25(1-b) a, 26 and 27 of Arms Act, pending in the court of learned C.J.M., Buxar.

As per prosecution, one loaded country made pistol and two live cartridges are said to have been recovered from the possession of the petitioner.

It is submitted by the learned counsel for the petitioner that nothing has been recovered from conscious possession of the petitioner. As a matter of fact, the petitioner was apprehended by the police from jail gate while he was released and he was remanded in this case after five days. It is further submitted that charge sheet has been submitted in this case.

No.32587 of 2017 (2) dt.13-07-2017 2/2 Considering the fact that one loaded country made pistol and two live cartridges have been recovered from his possession and the petitioner has criminal antecedent and altogether 16 criminal cases are pending against him, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

However, the trial court is directed to conclude the trial of the case within a period of six months from the date of receipt/ production of a copy of this order.
