02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 414 of the Indian Penal Code and Section 47(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
It is contended that, as per allegation, 200 pouches of country-made liquor each containing 200 ML, i.e., total 200 litres were recovered from the shop of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 27.05.2017.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.32650 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 347 of 2016 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
