JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Sultanganj P.S. Case No. 234 of 2015 for the offence under Sections 302 and 307/34 of the Indian Penal Code and also Section 27 of the Arms Act.

Learned counsel for the petitioner submits that in trial almost all the witnesses, except investigating officer and the doctor, have been examined. He submits that if the court below is directed to expedite the trial and ensure attendance of the investigating officer and doctor, the trial may be concluded within a period of three months.

Having regard to the facts that the petitioner is in custody for more than 1 1⁄2 years and the trial has commenced and except the investigating officer and the doctor, other witnesses

Patna High Court Cr.Misc. No.35763 of 2017 (2) dt.10-08-2017 2/2 have been examined, this Court thinks it proper to direct the court below to expedite the trial and ensure the attendance of the investigating officer and the doctor at the earliest and conclude the same preferably within a period of four months from today. With the aforesaid observations and directions, this application stands disposed of.

The trial court is also directed to conduct the trial on regular basis without granting any unnecessary adjournment to the parties.
