The petitioner filed this Criminal Miscellaneous for restoration of the order dated 28.02.2018 passed in Cr. Misc. No.5287 of 2018, which was dismissed for non-prosecution on 28.02.2018.

Learned counsel for the petitioner submits that he was operated on account of tooth ache and that is why he could not appear in court on the date fixed.
