JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Kanti P.S. Case No. 544 of 2016 for the offences punishable under sections 147, 148, 149, 341, 342, 307 and 353 of the I.P.C.

The learned counsel for the petitioners submits that similarly situated co-accused, namely, Dhiraj Kumar Sharma @ Dheeraj Kumar Sharma, Guddu Kumar Ray, Amar Rai and Mangru Sah have been allowed pre-arrest bail vide Cr. Misc. No. 54422 of 2017 by order dated 14.11.2017 by another co-ordinate Bench of this Court, vide Annexure-2 and further Sunil Rai and

Patna High Court Cr.Misc. No.24457 of 2018 (2) dt.25-04-2018 2/2 others have also been allowed pre-arrest bail vide Cr. Misc. No. 16141 of 2018 by another co-ordinate Bench of this Court, there is general and omnibus allegation against 200 persons including these petitioners for disturbing the traffic and obstructed the police in discharging their duty, no injury has been caused by these petitioners, the petitioner are accused in one case wherein they are on bail.

The learned A.P.P. fairly submits that other similarly situated co-accused have been allowed pre-arrest bail by another co-ordinate Bench of this Court.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M, West Muzaffarpur in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
