2. The petitioners are in custody in connection with Daudpur P.S Case No. 230 of 2023 registered for the offences punishable under Sections 304 (B) of the Indian Penal Code.
3. As per the prosecution case, on 8.7.3034, the informant along with her daughter-in-law namely Suman Devi went to deceased matrimonial house, where she found that her daughter has died due to hanging herself.
4. Learned counsel for the petitioners submits
Patna High Court CR. MISC. No.74671 of 2023(4) dt.21-02-2024 2/2 that petitioners have falsely been implicated in this case. It is also submitted that petitioner no.1 is in judicial custody since 09.07.2023 and petitioner no.2 is in judicial custody since 9.8.2023.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.
6. On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioners, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Daudpur P.S Case No. 230 of 2023.
