JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-08-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Biddupur Police Station Case No. 204 of 2016, disclosing offences under Sections 304B and 120B of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner and no specific overt act is attributed to him. In fact, the petitioner happens to be father-in-law of the deceased is innocent and has not committed any offence. Moreover, co-accused, Chinta Devi, who happens to be mother-in-law of the deceased, and Shankar Rai, have already been granted anticipatory bail by different

Patna High Court Cr.Misc. No.35859 of 2017 (2) dt.21-08-2017 Bench of this Court in Cr. Misc. No. 49283 of 2016 and 1611 of 2017. Hence, the petitioner who is of clean antecedent deserve the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of hi arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Biddupur Police Station Case No. 204 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
