The petitioners are apprehending their arrest in connection with Tajpur (Halai O.P.) P.S.Case No.222 of 2017 (G.lR.No.2076 of 2017) , registered for offences punishable under Sections 147, 148, 149, 307, 323, 324, 354 and 504 of the Indian Penal Code. Allegation against the petitioners is of assault to the husband of the informant and the informant and the allegation of assault is to another accused person Fuldeo Sahni to Sita Devi, who later on succumbed to the injuries.
Submission of the learned counsel for the petitioners is that there is no allegation of assault against the petitioner nos. 1 and 2 and so far petitioner nos.3 and 4 are concerned, there is allegation of assault against petitioner no.3 to the husband of the
Patna High Court Cr.Misc. No.20573 of 2018 (2) dt.26-04-2018 2/2 informant and against the petitioner no.4 of assault to the informant.

Having heard both sides and as there is no allegation of assault against petitioners to the deceased, let the petitioners, above named, surrender before the court below within a period of four weeks from the date of order and on their surrender they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur in connection with Tajpur (Halai O.P.) P.S.Case No.222 of 2017 (G.R.No.2076 of 2017) subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With following conditions :
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall co-operate in the investigation of the case and make themselves available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of their bail bond.
