JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 08-02-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. Petitioners seek regular bail in connection with Ara Muffasil P.S. Case No.297 of 2023 registered under Sections 304, 120B and 34 of the I.P.C.
3. As per prosecution case, it is alleged that the father of the informant died due to electric current which had been fenced around the pond intentionally by co-accused Suraj Kumar Singh. Petitioners are alleged to have participated in fencing of electric wire.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.73322 of 2023(4) dt.08-02-2024 2/2 case. There is a civil dispute between the families of petitioners and informant. Petitioner no.1 has one criminal case in which he is on bail and petitioner no.2 has got three criminal cases in which he is also on bail. Petitioners are in custody since 09.08.2023. It is further submitted that similarly situated coaccused Manoj Kumar Singh @ Jai Singh @ Jaiji Singh has already been granted bail by a coordinate bench of this Court vide order dated 10.01.2024 passed in Cr.Misc.No.77627 of 2023.
5. Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for bail of the petitioners.

Having considered the facts and circumstances of the case, submissions of the parties and the period of custody, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. VII, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No.297 of 2023.
