In this case, the petitioner is seeking anticipatory bail in connection with Gwalpara P.S. Case No. 140 of 2017, registered for the offence punishable under Sections 448, 341, 323, 334-B, 385, 379, 504 and 506/34 of the Indian Penal Code. Allegation has been made that the accused persons including the petitioner have entered into the courtyard of the informant and on the threat of gun they assaulted the informant by electric wire and later on, dragged her making her half naked.
Learned counsel for the petitioner submits that earlier a criminal case was lodged by the petitioner against the
Patna High Court Cr.Misc. No.22677 of 2018(2) dt.26-04-2018 2/2 informant side and for that they are also facing a criminal case that has been registered as Madhepura S.C./S.T. P.S. Case No.42 of 2017.
Looking to the entire facts and circumstances of the case, let the above-named petitioner, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Udakishunganj, District- Madhepura, in connection with Gwalpara P.S. Case no.140 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled. (Shivaji Pandey, J) pawan/- U T
