Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner in the present case is seeking regular bail in connection with Karjraili P.S. Case No. 22 of 2019 registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and the victim in her statement recorded under Section 164 Cr.P.C. has not named the petitioner. The victim in her statement under Section 164 Cr.P.C. has stated that she went with Govind Thakur out of her own sweet will and lived with him and performed marriage with Goind Thakur and she is carrying his eight months pregnancy.

Patna High Court CR. MISC. No.70376 of 2019(3) dt.27-11-2019 2/3 Learned APP has opposed the prayer of bail.

Considering the facts and circumstances of the case wherein the victim lady has made her statement under Section 164 Cr.P.c. in which she has stated that she had gone with the coaccused Govind Thakur and had left her maternal place on her own and she lived with said Govind Thakur and solemnized marriage with her as also that she is carrying his pregnancy and wants to live with him, there being no role of this petitioner in the marriage of the victim and in her living with said Govind Thakur, let the petitioner above named be released on bail in connection with Karjraili P.S. Case No. 22 of 2019 on furnishing of bail bond of Rs.

15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special judge, POCSO Act, Bhagalpur, subject to the condition as laid down under Section 437 (3) Cr.P.C.
