2. Petitioner in the present case is seeking release of the vehicle bearing registration No. BR09T7340, Chassis No.MA3EVB11S01691968 and Engine No. F8BIN4901937.

3. It appears that the vehicle in question has been seized and a case bearing Barauni (Zero Mile) P.S. Case No. 80 of 2025 dated 17.05.2025 has been registered under Sections 30(a), 33, 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022 and Section 302(2), 62 of the Bharatiya

Patna High Court CWJC No.17277 of 2025(2) dt.03-12-2025 2/2 Nyaya Sanhita, 2023.

4. It appears that the petitioner has not filed an application for release of the vehicle in question before the competent authority in terms of the Bihar Prohibition and Excise Rules, 2021 (as amended up to date).

5. Learned counsel for the petitioner prays for and is granted liberty to move before the District Magistrate, Begusarai/Confiscating Authority, as the case may be, with an appropriate application seeking release of the vehicle. If such an application is preferred within a period of 30 days from today, the District Magistrate, Begusarai shall consider the same and pass an appropriate order thereof within a reasonable period of time, keeping in view the several judicial pronouncements on the subject.

6. The writ application stands disposed off accordingly.
