2. Despite service of notice, nobody appears on behalf of the complainant.
3. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 498(A) of the Indian Penal Code.
4. Petitioner, who is husband of complainant, is said to have tortured upon her physically and mentally in association of his family members over the dowry demand.
5. It is submitted on behalf of the petitioner that the complainant had also filed another complaint case bearing
Patna High Court CR. MISC. No.74382 of 2024(3) dt.01-07-2025 2/2 Complaint Case No. 2893 of 2022 making similar allegations against the petitioner, but in the said complaint case, the parties have resolved their differences and the petitioner (husband) and the complainant (wife) are staying together which would appear from an order dated 01.07.2025 passed in Cr. Misc. No. 72255 of 2024.
6. Taking in view such condition that the petitioner and the complainant are staying together as husband and wife, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Complaint Case No. 1586 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.
