The learned single Judge has considered all the aspects of the matter in quite a detail and has found that the private respondent, whose husband was done to death by extremists, was entitled to compensation which has been envisaged under the policy.
The plea of the State that the death had happened due to a quarrel, which the husband of the private respondent had entered into while consuming liquor, has not been established by
Patna High Court LPA No.1078 of 2017(4) dt.15-05-2018 2/2 any kind of medical evidence etc. In other words, the plea was taken only to defeat the right of the private respondent. In totality, therefore, the Court is not inclined to interfere with the order impugned. Appeal is dismissed being devoid of merit.
