JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Sakra P.S. Case No. 260 of 2016, registered for offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code. Allegation against the petitioner is of killing the mother of the informant.

Submission of learned counsel for the petitioner that no specific allegation has been attributed to the petitioner and he has been made accused in this case only on the basis of suspicion. Further he has been in custody since 19.11.2016 and has no criminal antecedent.

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail. Learned counsel

Patna High Court Cr.Misc. No.37858 of 2017 (3) dt.24-08-2017 for the informant has submitted that petitioner is the main conspirator of the offence and earlier the petitioner and one coaccused Sanjay has threatened the deceased, which has come in one of the paragraphs of case diary. In para -72 of the case diary, confessional statement of co-accused is there, who has named the petitioner as the person at whose instance the deceased was killed and the prayer for bail of other accused, namely, Sanjay Singh having similar allegation, has already been rejected by this Court vide order dated 13.07.2017, passed in Criminal Miscellaneous No. 22535 of 2017.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed expedite the commitment of the case and try to conclude the trial as soon as possible preferably within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
