In this case, the petitioners are seeking anticipatory bail in connection with Ahiyapur P.S. Case No.622 of 2017, registered for the offence punishable under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code. Allegation has been made that when the informant along with others had gone to collect chanda for construction of Hanuman temple, the petitioners along with 25-30 unknown persons came armed with deadly weapons, entered into the house of the informant and committed loot. Allegation has been made that on the call of petitioner no.1 the accused- Golu Bhagat assaulted the informant by rod, which caused fracture of the hand. It has further been alleged that accused-Mukesh
Patna High Court Cr.Misc. No.22815 of 2018(2) dt.26-04-2018 2/2 Bhagat inflicted knife blow and accused-Chandan Thakur, snatched golden chain of the informant.
Learned counsel for the petitioners submits that the allegation is ornamental in nature.
Looking to the entire facts and circumstances of the case, let the petitioners above-named be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case no.622 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present. In failure to remain present on two consecutive dates without reasonable explanation, the present order will be treated to have been withdrawn.
