Petitioner apprehends his arrest in a case registered under Sections 302, 201, 34 of the Indian Penal Code. Informant is the mother of deceased, who in her written complaint has stated that the marriage of her daughter was solemnized with petitioner in the year 2008 and one children was also born from the said wedlock, but after marriage she was being tortured for non-fulfillment of demand of dowry. On 20.05.2019 petitioner and other co-accused persons killed her daughter.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.69822 of 2019(3) dt.19-12-2019 2/2 case due to dirty village politics. It has been further submitted that occurrence is of 20.05.2019, FIR was instituted on 21.05.2019 and the same was produced before the learned Magistrate on 23.05.2019. Co-villagers and neighbours have stated before the police that deceased committed suicide due to prolong illness. Daughter of deceased who slept with her deceased mother in the previous night also stated that she remained ill and committed suicide. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Kudhani P.S. Case No. 322 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
