In this case, the petitioner is apprehending his arrest in connection with Ladaniya P.S. Case No. 176 of 2017 corresponding to C.R.I. Case No. 1665 of 2017 registered for offences under sections 461 and 379 of the Indian Penal Code. As per allegation, in the previous night, the burglary of shop was committed and the mobile set of the Informant was recovered from Mukesh Yadav who has taken the name of the present petitioner.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the
Patna High Court Cr.Misc. No.26590 of 2018(2) dt.03-05-2018 2/2 petitioner, namely, Sanjay Sah is rejected.
If the petitioner surrenders before the court below and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
