JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 312/2019, registered for offences punishable under Sections 414/34/420/467/468 and 471 of the Indian Penal Code.

Prosecution case is that three accused persons were arrested with a motorcycle and one of them disclosed that the said motorcycle has been stolen by petitioner. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on the basis of confession of co-accused and except that there is nothing against the petitioner and he has been in custody for last six and half months and chargesheet has been submitted.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, in connection with Bettiah Town P.S. Case No. 312/2019 .
