The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (A), 35(A) and 38 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 781.20 litres of foreign liquor were allegedly recovered from the agricultural field behind the poultry farm of Rajesh Rai from where the petitioner was apprehended by the police on chase. Petitioner claims that he is having clean antecedent and is in custody since 04.06.2017.

No.40380 of 2017(2) dt.25-08-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-IIIcum-Special Judge, Excise Act, Muzaffarpur in connection with Deoriya P.S. Case No. 31 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
