JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-11-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Kahalgaon P.S. Case No. 656 of 2023 registered for the offences punishable under Sections-379, 420, 384 of the Indian Penal Code.

Allegedly, in the backdrop of a business transaction, the dispute arose between the parties and it is alleged that the informant supplied 500 bags of cement to the petitioner. It is further alleged that the amount of the cement was not paid to to the informant and he was threatened of dire consequences. Learned counsel for the petitioner has submitted that he is a person of clean antecedent. As a matter of fact, the

Additional Public Prosecutor opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 656 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
