1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Patliputra Police Station Case No. 276 of 2024, disclosing offences under Sections 318(4), 338, 336(3), 340(2) of the B.N.S., 2023.

3. As per the First Information Report, on 20.07.2024, in the first examination of Teacher Recruitment Competition Re-Examination of TRE-3 the brother of the petitioner appeared in his place.

4. Learned Counsel for the petitioner submits that the petitioner has been made accused due to some altercation/scuffle with the invigilator during the course of the

Patna High Court CR. MISC. No.74320 of 2024(2) dt.12-11-2024 2/2 examination. The brother of the petitioner who is co-accused has been granted regular bail by the learned Additional District Judge-XVIII, Patna.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that imposter has been granted regular bail by the Court below, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-X-cum-A.C.J.M.-X, Patna, in connection with Patliputra Police Station Case No. 276 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
