JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioners apprehend their arrest in connection with Ratanpura P. S. Case No. 49 of 2019 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioners is that the police on the basis of secret information raided the place of occurrence near the bank of Kosi river and recovered a total quantity of 72 litres of Nepali country made liquor from there. It has further been alleged upon seeing the police party, petitioners fled away from the place of occurrence who were identified by the Chaukidar. Mr. Arun, learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case and they have got no criminal antecedent. He

Patna High Court CR. MISC. No.65280 of 2019(2) dt.04-11-2019 2/2 submits that petitioners have allegedly been identified by the Chaukidar from behind while they were fleeing away and no illicit liquor has been recovered from the conscious possession or the premises of the petitioners.

Having regard to the submissions made by the parties and taking into consideration the fact that no illicit liquor has been recovered from the conscious possession or the premises belonging to the petitioners, I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ADJ-II-Cum-Special Judge (Excise), Supaul in connection with S.T.Excise 552 of 2019 arising out of Ratanpura P.S.Case No. 49 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
