The petitioners apprehend their arrest in connection with Sadar P.S. Case No. 248 of 2019, registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that on 19.06.2019, at about 12 P.M., Rajendra Yadav, Rabindra Yadav (petitioner no.2) and Devendra Yadav (petitioner no.3) started fixing pillar at the land of informant, Hukumdeo Yadabv. When he made protest then they started to abuse and on the order of Rajendra Yadav, both petitioners having sword and Farsa in their hand came and petitioner no. 1 caused injury at his head. Patna High Court CR. MISC. No.64366 of 2019(2) dt.23-10-2019 2/2 Manoj Yadav came to save him then he was also assaulted by petitioner no. 2 through Farsa. In the meantime, Rajendra Yadav snatched gold chain from his wife.

Learned counsel for the petitioners submits that due to land dispute occurrence took place, in which, petitioners' side also sustained injury, regarding which, Sadar P.S. Case No. 302 of 2019 is instituted on 25.02.2019 on the basis of Fradbeyan of co-accused, Rajendra Yadav, father of both petitioners. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Sadar P.S. Case No. 248 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
