The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a), 30(c), 41 of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 13 liters of illicit mahua liquor along with other materials used for preparation of illicit liquor are said to have been recovered from the place of occurrence. He submits that the apprehended person disclosed the name of the petitioner. He further submits that petitioner has one criminal antecedent as stated in para-3 of the bail application.

No.71298 of 2022(2) dt.13-01-2023 2/2 However, learned APP for the State opposes the prayer for bail and submits that the petitioner is the member of syndicate who was manufacturing the illicit liquor. Considering the facts and circumstance of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Sirdalla P.S. Case No. 381 of 2022.
