The petitioner seeks bail in Sessions Trial No. 345 of 2016 arising out of Desari P.S. Case No. 192 of 2012 registered for the offence under Section-302/34 of the Indian Penal Code and 27 of the Arms Act.
Earlier prayer for bail of the petitioner was rejected taking into account that he is the assailant. A report was called for from the trial court. It has been reported that out of seven prosecution witnesses, five prosecution witnesses have already been examined and the case is likely to be concluded within a period of six months.
Considering the nature of accusation and stage of the case, I am not inclined to grant bail to the petitioner.
Patna High Court CR. MISC. No.70564 of 2022(3) dt.15-02-2023 2/2 Accordingly, prayer for bail of the petitioner is rejected. The trial court is directed to take all necessary steps to expedite the trial and conclude the same as early as possible, preferably within a period of six months from the date of receipt/production of copy of this order.
The District Magistrate and the Superintendent of Police, Vaishali at Hajipur are directed to produce the prosecution witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of six months.
Let a copy of this order be communicated to the District Magistrate and the Superintendent of Police, Vaishali at Hajipur for needful.
