JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Jalley P.S. Case No.06 of 2018 registered under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code and Section 138 of the Electricity Act, 2003.

Considering the allegations made in the first information report that the petitioner being a Rural Revenue Franchisee appointed by the North Bihar Power Distribution Company Limited collected rupees eleven lacs seventy two thousand nine hundred fifty six from 183 consumers and did not issue deposit

Patna High Court Cr.Misc. No.26217 of 2018 (2) dt.03-05-2018 2/2 receipt to them and illegally adjusted the amount in the electricity bill, I am not inclined to grant him pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.

The petitioner may surrender and seek bail which shall be considered on its own merits without being prejudiced in any manner by this order.
